Not every Orange County address sits inside a city. Unincorporated parcels are county territory, and there the County of Orange is the permitting authority, not a city building department. That covers the Santa Ana Mountains canyons, Silverado, Modjeska, Santiago and Trabuco, along with North Tustin and county islands like Midway City, Santa Ana Heights and Rossmoor. Mail can still carry a nearby city's name, which is why the first thing we settle is which jurisdiction actually reviews your project.
The standards come from the County of Orange Comprehensive Zoning Code, Sec. 7-9-90, adopted July 25, 2024. It applies in any district, including planned community and specific plan areas, and the permit is ministerial. A new attached or detached unit inside the building site area can reach 1,200 sq ft. The rule that decides most designs is narrower: a new unit built partly or wholly inside the side or rear setback area is capped at 800 sq ft, 16 ft in height, and 4 ft off the side and rear lines.
Two things separate an unincorporated parcel from a city lot. Septic is common out here, and where a private onsite wastewater system is required it has to meet the Orange County Plumbing Code. And owners regularly confuse an ADU with a guesthouse: a guesthouse under Sec. 7-9-91 cannot contain a kitchen and cannot be rented at all, while an ADU can be rented long term, over 30 days, but never as a short-term rental.
